General Terms and Conditions


Seahorse Marine School Ltd is committed to providing a safe, professional, and enjoyable training environment. By booking or participating in any course, trainees acknowledge that they have read, understood, and agree to the following Terms and Conditions.
These terms apply to all training, courses, and equipment use provided by Seahorse Marine School Ltd.

1. Assumption of Risk
1.1 Boating and water-based activities involve inherent risks.
1.2 These risks may include, but are not limited to:
•    slips and falls
•    capsizing
•    collisions
•    immersion in cold water
•    adverse weather conditions
•    equipment failure
•    other hazards associated with marine environments.
1.3 Participation in all activities is voluntary and undertaken at the participant’s own risk.

 

2. Safety Requirements
2.1 All trainees must follow the instructions of instructors at all times.
2.2 Safety briefings must be followed before and during practical sessions.
2.3 Appropriate safety equipment, including buoyancy aids, must be worn when instructed by staff.
2.4 Trainees must wear suitable clothing appropriate for the weather and water conditions.
2.5 Failure to follow safety instructions may result in removal from the course without refund.

 

3. Personal Responsibility
3.1 All individuals using Seahorse Marine School facilities are responsible for:
•    their own safety
•    the safety of others
•    using equipment correctly
•    following instructor directions.
3.2 Equipment must be used correctly and in accordance with instructor guidance.
3.3 Any damage, malfunction, or safety concern must be reported immediately to Seahorse Marine School staff.

 

4. Emergency Procedures
4.1 In the event of an emergency, trainees must immediately notify Seahorse Marine School staff.
4.2 Trainees must follow all emergency procedures and instructions provided by instructors.

 

5. Third-Party Damage Liability
5.1 The trainee accepts full responsibility for any damage, loss, or injury caused to third parties, vessels, property, marina infrastructure, or other equipment arising from the trainee’s operation or use of any vessel or Personal Watercraft during training.
5.2 The trainee agrees to indemnify and hold harmless Seahorse Marine School Ltd from any claims, costs, damages, legal expenses, or liabilities arising from such incidents.
5.3 Where damage occurs to another vessel, marina structure, mooring, pontoon, or other property as a result of the trainee’s actions, the trainee agrees to reimburse Seahorse Marine School Ltd for any costs, insurance excess, repair charges, or compensation paid to third parties.
5.4 This clause applies whether damage occurs:
•    on the water
•    during launch or recovery
•    while manoeuvring in harbours, marinas, rivers, or coastal areas.

 

6. Insurance Requirements
6.1 Trainees using their own vessels, jet skis, or personal watercraft must hold valid insurance.
6.2 Insurance must include a minimum of £3 million public liability cover.
6.3 Proof of insurance may be requested before participation in training.

 

7. Course Bookings and Payments
7.1 All courses must be booked in advance.
7.2 Full payment must be received 7 days prior to the course start date.
7.3 Seahorse Marine School reserves the right to reschedule courses if minimum participant numbers are not met.
7.4 Trainees must arrive at least 15 minutes before the scheduled course start time.
 

8. Cancellations and Refunds
8.1 Cancellations by the Trainee
8.1.1 Cancellations made more than 7 days before the course start date are eligible for a full refund or transfer.
8.1.2 Cancellations made within 7 days of the course start date are non-refundable.
8.1.3 Transfers within 7 days may be offered at the discretion of Seahorse Marine School.
8.2 Cancellations by Seahorse Marine School
8.2.1 If a course is cancelled due to weather conditions, staff illness, safety concerns, or unforeseen circumstances, Seahorse Marine School will offer a transfer to a mutually convenient date.

 

9. Certification and Data
9.1 Certificates or licences will be issued upon successful completion of the course where applicable.
9.2 Trainees must ensure that all personal information provided during booking is accurate.

 

10. RYA Data Submission
10.1 Upon successful completion of an RYA course, Seahorse Marine School must submit trainee details to the Royal Yachting Association (RYA).
10.2 Submitted information may include:
•    Name
•    Contact details
•    Date of birth
•    Certificate number
•    Issue date
10.3 This allows certificates to be verified or replaced if necessary.

 

11. Conduct and Behaviour
11.1 Seahorse Marine School reserves the right to refuse entry or remove any individual who:
•    is intoxicated
•    behaves in a disruptive or unsafe manner
•    is abusive toward staff or other trainees
•    acts in a way that compromises safety.
11.2 No refunds will be issued if a participant is removed due to misconduct.
 

12. Removal From Training
12.1 Seahorse Marine School Ltd reserves the right to terminate a trainee’s participation in any course if the trainee behaves in a manner that is unsafe, disruptive, or fails to follow instructor instructions.
12.2 If a trainee is removed from training for safety reasons, Seahorse Marine School Ltd may require the trainee to leave the training area or vessel immediately.
12.3 No refund, transfer, or compensation will be provided where a trainee is removed from training due to misconduct, unsafe behaviour, or failure to comply with safety instructions.
12.4 Seahorse Marine School Ltd reserves the right to terminate training immediately where continuing the activity may place participants, instructors, vessels, or the public at risk.

 

13. Participation and Suitability
13.1 Training takes place in a marine environment that may be physically demanding.
13.2 Participants must ensure they are medically fit and capable of participating in practical water-based training.
13.3 Trainees must ensure they are appropriately dressed for all weather conditions.

 

14. Website Information Disclaimer
14.1 Information provided on the Seahorse Marine School website is for general guidance only.
14.2 Content may change without notice.
14.3 Seahorse Marine School excludes liability for inaccuracies to the fullest extent permitted by law.

 

15. Assumption of Risk – Vessel Operation
15.1 The trainee acknowledges that operating a jetski, personal watercraft, or powerboat involves inherent risks.
15.2 These risks may include collision, capsizing, injury, equipment failure, or death.
15.3 The trainee voluntarily accepts all risks associated with participation.

 

16. Release of Liability
16.1 The trainee agrees that Seahorse Marine School Ltd shall not be held liable for injury, loss, or damage arising from participation in training activities or equipment hire.
16.2 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under UK law.

 

17. Indemnity
17.1 The trainee agrees to indemnify and hold harmless Seahorse Marine School Ltd against claims arising from misuse of equipment.
17.2 This includes damage caused to third parties, property, vessels, or equipment.
17.3 The trainee may be liable for repair costs, damage, or lost rental income resulting from misuse or negligence.
 

18. Compliance With Instructor Instructions
18.1 Trainees must follow all instructions given by instructors during training activities.
18.2 Seahorse Marine School Ltd shall not be liable for injury, damage, or loss resulting from a trainee failing to follow instructor instructions or safety briefings.

PWC/Jetski Hire & Rental Agreement


These terms apply to all training, courses, and equipment use provided by Seahorse Marine School Ltd.
This Rental Agreement applies to all renters, operators, passengers, and users of Personal Watercraft (PWC) provided by Seahorse Marine School Ltd.
For the purposes of this agreement, the term “Rental Company” refers to Seahorse Marine School Ltd and its employees, instructors, agents, representatives, and insurers.
 

1. Age Requirements
1.1 The renter must be at least 18 years of age to hire a Personal Watercraft.
1.2 Persons under the age of 16 years may only operate a Personal Watercraft within a supervised training environment where permitted by Seahorse Marine School instructors and with a responsible adult. 
 

2. Assumption of Risk
2.1 The renter acknowledges that operating or riding a Personal Watercraft involves inherent risks.
2.2 These risks may include, but are not limited to:
•    collisions with vessels or objects
•    capsizing
•    falling from the craft
•    impact with other vessels or structures
•    mechanical failure
•    immersion in cold water
•    injury or death
2.3 Participation in any activity involving the Personal Watercraft is voluntary and undertaken at the renter’s own risk.
 

3. Release of Liability
3.1 The renter agrees that Seahorse Marine School Ltd shall not be held liable for injury, loss, or damage arising from participation in training activities or use of rental equipment.
3.2 Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under UK law.
 

4. Indemnity
4.1 The renter agrees to indemnify and hold harmless Seahorse Marine School Ltd against claims arising from misuse of equipment.
4.2 This includes claims relating to damage to third parties, vessels, property, or equipment caused during the rental period.
14.3 The renter will be liable for repair costs, damage, or lost rental income resulting from misuse or negligence.

 

5. Third-Party Damage Liability
5.1 The renter accepts full responsibility for any damage, loss, or injury caused to third parties, vessels, property, marina infrastructure, or other equipment arising from the renter’s operation or use of the Personal Watercraft.
5.2 The renter agrees to indemnify and hold harmless Seahorse Marine School Ltd from any claims, costs, damages, legal expenses, or liabilities arising from such incidents.
5.3 Where damage occurs to another vessel, marina structure, mooring, pontoon, or other property as a result of the renter’s actions, the renter agrees to reimburse Seahorse Marine School Ltd for any costs, insurance excess, repair charges, or compensation paid to third parties.
5.4 This clause applies whether the damage occurs:
•    on the water
•    during launch or recovery
•    while manoeuvring in harbours, marinas, rivers, or coastal areas.
 

6. Rental Terms
6.1 This agreement applies for the duration of the training day unless otherwise agreed.
6.2 The Personal Watercraft remains the property of Seahorse Marine School Ltd at all times.
6.3 The renter must follow all instructor instructions and operating procedures.
6.4 The Personal Watercraft must only be used for authorised training purposes.
7. Equipment Responsibility
7.1 The renter must operate the Personal Watercraft in a safe and responsible manner at all times.
7.2 The renter must comply with all safety instructions and operational guidance provided by instructors.
7.3 The renter is responsible for loss, theft, or damage to the Personal Watercraft during the hire period.
7.4 Any damage, malfunction, or safety concern must be reported immediately to the instructor.
 

8. Equipment Condition Acknowledgement
8.1 Prior to commencing training, the renter will be given the opportunity to inspect the Personal Watercraft and associated equipment.
8.2 By taking possession of the Personal Watercraft, the renter confirms that the equipment has been inspected and accepted as being in good working condition unless otherwise noted by the instructor.
8.3 Any existing damage must be reported to the instructor before the Personal Watercraft is used.
8.4 Damage discovered after the training session that was not previously reported may be deemed to have occurred during the rental period.
8.5 The renter may be held responsible for repair costs, insurance excess, or loss of use resulting from damage occurring during the rental period.
 


9.1 The approximate value of the Personal Watercraft is £10,000.
9.2 The hire cost for a shared Personal Watercraft is £65 per person per day, including fuel.
 

10. Acceptable Use
10.1 The Personal Watercraft must not be used:
•    for racing or stunts
•    for towing persons or property
•    under the influence of alcohol or drugs
•    in a reckless or negligent manner
•    for any unlawful purpose.
 

11. Compliance With Instructor Instructions
11.1 The renter must follow all instructions provided by Seahorse Marine School instructors during training activities.
11.2 Seahorse Marine School Ltd shall not be liable for injury, damage, or loss resulting from a renter failing to follow instructor instructions or safety briefings.
 

12. Damage Security Authorisation
12.1 The renter agrees that Seahorse Marine School Ltd may retain card details or take a damage security authorisation prior to the rental.
12.2 This authorisation may be used to recover costs relating to:
•    repair of damaged equipment
•    insurance excess
•    replacement of lost equipment
•    loss of rental income caused by damage to the Personal Watercraft.
12.3 Seahorse Marine School Ltd will notify the renter before processing any charge relating to damage.
 

13. Notice to the Renter
13.1 This agreement is a hire agreement only and does not transfer ownership of the Personal Watercraft.
13.2 The renter may be liable for repair costs, damage, or lost rental income resulting from misuse or negligence.
14. Equipment Return & Damage Check
The Personal Watercraft will be inspected by the instructor at the end of the training session.
If no damage is identified, this section of the agreement will be returned to the renter and no further action will be taken.
If damage is identified that occurred during the rental period, Seahorse Marine School Ltd reserves the right to recover the reasonable cost of repair, insurance excess, or loss of use in accordance with this agreement.
